1. Identity and Applicability

These terms and conditions ("Terms") apply to your use of the web application CallSanta.Online ("Service" or "CallSanta.Online"):

By creating an account, logging in, or using the Service through our website/web app, you agree to these Terms. The Service is intended solely for consumers (parents/guardians using the Service with or for their children) and not for business resale or commercial exploitation, unless expressly agreed otherwise in writing.

2. Purpose and Use (Family Entertainment)

CallSanta.Online is an online family entertainment service. Through an interactive AI avatar, families can have a real-time conversation with Santa Claus. The Service is family-oriented. Children may not use the Service independently; a parent or legal guardian (18+) must always be present and responsible.

3. Accounts and Access

To use the Service, you must create an account.

3.3.1 Account Registration

During registration we may request:
- Your email address
- A password or login method (e.g., magic link, email code)
- Optional: your name

You guarantee that the information you provide is correct and up to date, and that you are 18 years or older.

3.3.2 Account Security

You are responsible for:
- Keeping your login details confidential
- All actions taken through your account
- Immediately reporting (suspected) misuse via [email protected]

We may block or restrict accounts in cases of (suspected) misuse, fraud, or violations of these Terms.

4. Payments (Call Minutes via Mollie)

4.4.1 Call Minutes and Digital Content

Within CallSanta.Online, you can purchase bundles of call minutes (for example, a bundle of 10 minutes of conversation time) to speak live with the Santa Claus avatar.
- Call minutes are digital content / a digital service on a non-physical carrier.
- Minutes are deducted in real time during a conversation.
- Remaining minutes stay linked to your account for as long as the Service is available.

4.4.2 Payment Processing via Mollie

Payments are processed through our payment provider Mollie.
- We do not process or store bank or credit card details.
- Mollie acts as an independent controller for your payment data.
- Payment status is shared with us so we can activate your purchased call minutes.

4.4.3 Prices and VAT

4.4.4 Right of Withdrawal

Where legally permitted: By confirming during checkout that call minutes may be delivered immediately, you consent to immediate performance of the digital service and waive the statutory right of withdrawal for this digital content.
We offer a voluntary goodwill money-back guarantee. If technical issues occur, you may request a refund within 24 hours. This is in addition to your statutory rights.

4.4.5 Personal Account

Call minutes are personal to your account, non-transferable, and not intended for resale. However, sharing your account with immediate family members (such as grandparents) for personal, supervised use is permitted, provided the Account Holder remains fully responsible for all activity. Misuse (including fraudulent payments or chargeback abuse) may result in blocking your account.

4.4.6 No Monetary Value

Call minutes and other digital content have no monetary value, do not constitute property rights, and are non-refundable except where required by applicable law.

5. Permitted and Prohibited Use

5.5.1 Permitted Use

You may use the Service only:
- For its intended family and entertainment purpose
- In accordance with these Terms and applicable law

5.5.2 Prohibited Use

You may not:
- Circumvent security measures or parental gates
- Reverse-engineer, hack, scrape, or manipulate the Service
- Upload, record, or distribute unlawful, hateful, discriminatory, threatening, sexually explicit, or harmful content
- Commercially exploit the Service without written permission
- Share material for which you do not hold rights
- Use the Service in a way that overloads or disrupts the infrastructure

We may investigate potential violations and take appropriate measures.

6. Intellectual Property and License

The Service—including software, UI, avatar(s), images, text, and trademarks—is protected by intellectual property rights and remains the property of Ringsdale BV or its licensors. You receive a personal, limited, non-exclusive, non-transferable license to use the Service as described in these Terms.

You may not, without written permission:
- Copy, modify, publish, distribute, or create derivative works of the Service
- Remove or alter logos, trademarks, or copyright notices

7. Third-Party Services

To operate CallSanta.Online we use reliable service providers, including:
- LiveKit – real-time audio/video
- Hedra – avatar animation
- OpenAI – speech recognition and AI responses
- DigitalCloud – hosting and storage
- Mollie – payment processing

Personal data processing by these parties is detailed in our Privacy Policy, which forms an integral part of these Terms.

8. Privacy

We process personal data in accordance with applicable data protection laws. The Privacy Policy is available at: https://callsanta.online/privacy

9. Availability, Updates, and Changes

We strive for a stable and secure Service, but:
- Continuous, error-free operation cannot be guaranteed
- We may modify or discontinue parts of the Service (e.g., maintenance, legal changes, security reasons)
- For significant changes, we will make a reasonable effort to notify you in advance.

We will respond as soon as possible, respecting legal deadlines. If the Service malfunctions, we will investigate and resolve issues in accordance with EU digital content laws.

11. Liability

The Service is provided "as is." To the extent permitted by law:
- We exclude liability for indirect or consequential damages, including data loss
- Our total liability per user per event is limited to the amount you paid to us in the last month, unless caused by intent, gross negligence, or required otherwise by mandatory law
- The Service is not intended for emergency use or professional advice.

12. Termination and Suspension

12.12.1 By Us

We may suspend or terminate your account if:
- You violate these Terms or the law
- There is fraud, misuse, or security risk

We will notify you where reasonably possible unless prohibited by law.

12.12.2 By You

You may delete your account at any time via account settings or by emailing [email protected]. Purchased call minutes generally expire upon account deletion, unless mandatory law requires otherwise. Unused call minutes remain available while your account is active and the Service continues to operate.

13. Force Majeure

We are not liable for delays or non-performance caused by external circumstances including:
- Hosting outages
- Power failures
- Government action
- Third-party failures (e.g., payment providers)

14. Applicable Law and Jurisdiction

Dutch law applies, without prejudice to mandatory consumer protection in your country of residence. Disputes will be resolved by the competent court in Amsterdam, unless mandatory law dictates otherwise.

14.1 Nothing in these Terms affects your statutory rights under the UK Consumer Rights Act 2015.

15. Changes to These Terms

We may update these Terms due to:
- Legal changes
- Service updates
- Operational changes

The date above reflects the latest version. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
